Javea Resident Loses Appeal


A villa which was being built in a rural area of javea on a 12,000 square metre plot has been demolished .The owner made an unsuccessful appeal to the Constitutional Court .The house was being built by the owner and his claim was that even if the build was illegal it could have been legalised very easily .He says that if the plot is over 10,000 square metres a residential property can be built there .

He , it seems , applied for planning permission and started to build before this came through , a practice which is common in Javea , according to sources from the town hall ..However the Ministry of Housing did not sanction the first phase of the development and the council rejected the application .

After ” appealing ” to the council the builder says that he had permission to build by means of ” administrative ” silence , whereby the council has automatically given permission via their silence to actually reject it before a given deadline .

One of the builders neighbours reported the continued building of the house to the council and the council rejected the application once again .It is claimed that the ” neighbour ” used blackmail on the builder saying that he would withdraw his complaint for 150,000 euros .The mayor and the planning councillor were both said to be ” between a rock and a hard place ” over these issues .They could also have got into trouble if they had granted permission after the Constitutional Court had denied it .So the house was bulldozed .
